Pasion for photography

This contract is between JRV Timeless Photography and the person who has either 1. Booked a photoshoot, or 2.Paid for a photoshoot , or 3. Received as a gift.

We will always do our best to fulfil and, hopefully, even exceed your photography needs. But it is often best for everyone to have a few things written down so that we both know what is what, who does what and when, and what happens if something goes wrong.

Acceptance of Terms and Conditions:


All contracts and transactions between the Photographer and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between the Photographer and all or any of its Clients.The Photography undertakes to deliver an edited product of the wedding day/ day of session with specific features as contained and outlined in the package offered by the photographer as selected by the client/s.

Cancellations & Rebookings:


  • Cancellation & Rebooking without an additional booking fee is possible up to 5 days before the photosession.
  • Any cancellations & rebooking after 1 to 4 days before photosession will include an additional booking fee of R250. Excluding reasons like weather, illness (proof of doctor'scertificate), or death of family member (proof of death certificate).
  • If the rebooking of a photosession is not made in the next 3 months after cancellation date of previous photosession, the client will need to make a new booking and will not receive refund of the deposit from the previous photosession.
  • Cancellation before 15 days of photosession, the client may recieve a refund. (Non-Wedding photosessions)


Pre/During Session:


Client & Photographer will meet at pre determined Date, Time & Place, DO NOT BE LATE! The Client understands that session times are booked according to a shooting schedule. The photographer will not be held liable for Client's loss in session time & session fee, the Client(s) are responsible for arriving on time.

In the case that the Client is not on time, the time will be deducted from the original agreed session time and the Photographer will not be held responsible for loss of suitable shooting light or the missed amount of images agreed upon not obtained within the time remaining for the planned session. Calculate your travel & traffic time accordingly!

In the case that the Client did not show up at all, completely missing the entire booked session, a rebooking fee of R250 is payable to reschedule a new date/timeslot.

The client is responsible for the conduct of their guests. Photographer will not tolerate verbally or physically abusive behavior, nor will the Photographer share their time, or compete for the attention of subjects. Unchecked guest conduct interferes with the quality of the images and the time taken to retake missed images due to guest involvement. A loss in time results in a loss in images of other subjects. The photographer will not be able to take photos where there are laser lights as they can damage the camera and camera lens.

Small Children: The photographer understands that small children can be very unpredictable and still learning to communicate or vocalize their feelings or intentions. Therefore it is agreed that booking and paying for a photo session is at the own risk and discretion of the client and understands that it may potentially result in a photo shoot failure.

Co- Operation / No Shows: The parties agree to positive co-opration and communication for best possible result within the definition of the assignment. Client is responsible to clearly communicate to photographer if certain individuals in the attended group must not be photographed in abundance. Photographer will handle this matter discreetly. Photographer is not responsible for key individuals' failure to be present and/or co-operate during photo sessions throughout the session time, neither for missed images due to details not revealed to photographer in advance.

Weddings : Our wedding packages does not include travel fees and traveling will be charged separately at R4,50 per km. We will require overnight accommodation, if the wedding is more than 80km from our office in Uitenhage.

To book a 2nd Photographer an additional cost of R150 per hour will be charged.

Travelling outside Uitenhage/Despatch without overnight accommodation, I will not work later than 20:00 as the road home is dangerous at night.

Post Session:


The retouching and editing process takes approximately 20 working days to complete depending on the level of retouching required, amount of images to be retouched, Eskom loadshedding and photographers schedule. The client will abide be these conditions and accept that clients are serviced on a first come first served basis. The client will not put the photographer under any pressure to preform faster in any way or form. Wedding photos retouching and editing process takes approximately 30 working days because of the amount of photos.

Injury: Client shall not hold Photographer responsible for any injury or harm that may come to Client/s during a photo shoot/session.

Final Product:


All images will be uploaded onto our digital gallery for the client to download at the highest resolution for best looking images. The client will receive a link and password sent via WhatsApp or email, with instructions to download the images. The gallery will be available online for 3 months. The client is responsible to download and backup session images on own devices and/or cloud. Print products typically takes an additional 14-25 days to manufacture after client have chosen the photos to be printed. The client will be contacted as soon as it's ready.

No images or content may be copied, duplicated or otherwise taken from the website without a password that will be given by the photographer

The client will not receive any unedited photos.

Images chosen are solely at the Photographer's discretion and the client will accept the Photographer's professional discretion in this matter. The client accepts that technical considerations in photography might result in a specific shot not being suitable for publication or delivering to the client.

Weather:


The photographer cannot control the weather. All outdoor sessions are dependant on weather conditions, and the client will not force the photographer to use their equipment if the photographer deems the weather to be unsuitable. In case of unsuitable weather conditions, the date will be rescheduled. Due to the sensitive nature of camera equipment the photographer reserves the right to stop shooting, and take necessary steps to protect the camera equipment, in the case of bad weather breaking out. If it is not possible for a photo shoot / session to take place on the scheduled day due to weather the photographer and client will reschedule on an agreed date as soon as possible with no additional charge.

Photographer will not be held liable for wardrobe failure, including and not limited to visible objects in pockets, including and not limited to underwear showing or fitted incorrectly. Photographer will not be held responsible for unclear eyes while client is wearing reflective or bifocal glasses.

Photographer will not be held liable for make-up failure, including and not limited to uneven tone, excessive blotched or irritated skin, intentional or unintentional shining of skin, smudged or clogged mascara or make-up smeared or transferred to clothing or guests.

Photographer will not be held liable for hair failure, including and not limited to incorrect hair colour, freshly dyed hair stains on forehead, neck and ears, faulty hair cut & flyaway hairs.

Display:


Clients release all claims to profits that may or may not arise from use of such images. The Client agrees to the publication of a blog entry on the Photographer's Social Media, the final images are at the Photographer's discretion if any.

The client hereby permit and allow the photographer to display

any images covered by this contract and to generally promote the business by means of

advertising, publicity material, websites, exhibitions, competitions, magazine articles,

and other such media, providing that the images are used lawfully and without damage the client.

It is specifically agreed that the material may be used on social media forums as is

desired, and that the clients may be tagged, or otherwise identified, unless otherwise agreed in writing.

If the Client does not want images posted to Social Media, including and not limited to Facebook, Instagram, Tiktok, Websites, the Photographer must receive written objection, (in the form of email, whatsapp msg or private msg) anytime within a week before or a week after booked session is entered into. If any other information like names, or birth dates or any other personal information should not be shared on social media, the same written requests must reach the Photographer within a week before or a week after the session is entered into. Please advise the Photographer of any religious/cultural considerations before the session date.

Payment Terms:


A 25% booking fee for photo sessions is payable (within 4- 15 days) to secure

the date and time agreed on, the sessions must then be paid in full 3-4 days or in cash on the day of the shoot in case the amount due is less than R700. This booking fee is refundable 3 months before the photo session otherwise the booking fee will be non-refundable, it being the agreed loss suffered by the photographer due to client cancellation or client failing to be

on time for the session. Balance of payment - is payable from 7 to 4 days before and on the day of the photo-shoot. No images will be released until the final balance is paid in full.

Client can change the date of the photo session at anytime before the scheduled date. In a case where the photographer needs to cancel a photo session due to being ill or for an unforeseen incident, the client can choose to be refunded in full for the amount that they have already paid for or move the date of the photo session.

Travelling expenses will be quoted separately outside of Uitenhage/ Despatch as well as outside Port Elizabeth.

Only EFT payments or Cash payments will be accepted, NO e-wallet.

Body Image & Self-care:


The Photographer encourages positive body image. Client can quickly cover up unwanted or extra kilos with flattering clothing and accessories. The client may not request dramatic digital body changing alterations. It is the responsibility of the client to affirm self-care of themselves and their guests to arrive and ready to start with clean face, nose, teeth, clothes, and nails.

Refunds:


The return of any technically acceptable photographs and/or prints, or demands for refund, will not be entertained on principle. No exception can be made to this rule as the photographer cannot be held responsible for individual tastes or expectations and the judgment, view, execution and layout of the photographer will be deemed to be correct.
